By engaging Shrinidhi Enterprises (“Company,” “we,” “us”) for any on-site service, you (“Client,” “you”) are agreeing to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and the Company.
2. Scope of Services
We will perform the services as described in the service agreement, work order, or verbal agreement made at the time of booking. Any changes or additions to the scope of services must be agreed upon by both parties and may result in a price adjustment.
3. Client Responsibilities
As a client, you agree to:
Provide complete and accurate information about the service requirements and location.
Ensure our personnel have safe and unobstructed access to the service area.
Cooperate with our team to facilitate the efficient execution of the service.
Inform our team of any potential hazards or special conditions at the service location.
4. Fees, Billing, and Payment
Pricing: Service charges will be based on the agreed-upon rates. All prices are subject to applicable taxes, including GST.
Invoicing: An invoice will be provided upon completion of the service.
Payment: Payment is due upon receipt of the invoice unless otherwise agreed in writing. Failure to make timely payment may result in late fees or suspension of future services.
5. Cancellation and Rescheduling
By the Client: We request a minimum of 24 hours’ notice for any cancellation or rescheduling of a service. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee.
By the Company: We reserve the right to cancel or reschedule an appointment due to unforeseen circumstances. We will provide as much notice as possible and will work with you to find an alternative date and time.
6. Limitation of Liability
To the fullest extent permitted by law, Shrinidhi Enterprises shall not be liable for any indirect, incidental, special, or consequential damages resulting from our services. Our total liability for any claim arising out of our service is limited to the amount paid by the client for that specific service. This limitation does not apply to damages resulting from our gross negligence or willful misconduct.
7. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mangaluru, Karnataka. The parties agree to first attempt to resolve any dispute through good-faith negotiation, followed by arbitration in Mangaluru as per the Arbitration and Conciliation Act, 1996, if necessary.
8. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Your continued engagement of our services after any such change constitutes your acceptance of the new Terms.
